NRC Welcomes court decision slamming Home Office delay
The NRC has welcomed the decision of the decision of the Court of Appeal in S(Afghanistan)which stated that delay by the Home Office was unlawful in certain circumstances.
In 2001 the Immigration and Nationality Directorate of the Home Office decided to put to one side all asylum applications not decided within 60 days. They paid no regard to individual factors. Some asylum seekers were affected by this delay and as a result by missed out on Home Office concessions that were withdrawn before their cases were decided.
The Court's decision, made on 20th June 2007, means that groups of Afghanis, Iraqis, Sierra Leoneans and Angolans adversely affected may be able to apply for permission to stay in the UK.
For further details see the briefings produced by the National Coalition of Anti-Deportation Campaigns and by the Refugee Council.
In some areas of Yorkshire and Humberside in particular, there is an acute shortage of solicitors dealing with refugee cases and those affected may experience difficulty in obtaining advice. The NRC Advice Service, does not undertake asylum casework. However, we have produced a standard letter for those who think they may be affected to send to the Border and Immigration Agency of the Home Office, pending obtaining representation. This has been done because in many cases those who could claim under this judgment are destitute and lodging a claim can bring with it entitlement to support from the Home Office. The letter is made available from our advice service without any 'warranty' and should only be used if you have thoroughly read the briefings above.
